These general terms and conditions for online shop: http:\/\/kocbek.si\/trgovina\/ have been created in accordance with Law on Consumer Protection (ZVPot), Law on the Consumer Protection against Unfair Commercial Practices (ZVPNPP), Law on Electronic Commerce Market (ZEPT) and the international e-commerce rules.

The online shop on the webpage kocbek.si or: http:\/\/kocbek.si\/trgovina\/ is an information system designed to present and sell products to the user. It is online operated by the Oljarna Kocbek, Gorazd Kocbek s.p., hereinafter referred to as the Seller. The user is a person who uses the system, i.e. the customer in the online shop. The general terms and conditions of operation deal with the operation of the online shop: http:\/\/kocbek.si, the rights of the user and the business relationship between the seller and the user\/customer.

PROTECTION OF PERSONAL DATA:
We commit ourselves to the permanent protection of all the personal data of the customer (user) who wrote them at the time of purchase (name, surname, address, mail, telephone, e-mail) and we keep documentation of the communication with him. We will use personal data about the customer exclusively for the purpose of fulfilling the order (sending e-news, offers, bills) and other necessary communication. In any case, we will not disclose the data to unauthorized or third parties. In case the customer (user) wants to edit or delete the data from our list, he can send us the information on this e-mail address: info@kocbek.si, or send us a written request via post to Oljarna Kocbek, Gorazd Kocbek s.p. Stara gora 1, 9244 Sv. Jurij ob \u0160\u010davnici.

PRICES:\nAll prices of our products are clearly indicated and VAT included. The seller reserves the right to daily price changes unless otherwise stated. The prices listed on the website do not include shipping costs. Prices are valid at the time of the order and do not have a predefined validity time. Prices apply in the case of payment according to the payment methods and conditions specified herein.

PURCHASE PROCEDURE:\nThe customer chooses the type and quantity of the product. Prior to submitting the order, he checks the shopping cart, makes corrections if necessary, or proceeds with the purchase and confirms the order. Then he completes a form entering all the information necessary for the delivery of the selected product. After confirming the purchase, changes are no longer possible. Upon completion of the purchase, a notice of the completed purchase will be sent to the user via e-mail. If the customer has chosen the payment against the pro forma invoice, the pro forma invoice will be sent to his e-mail address. The seller delivers the ordered products through the contractual partner (Po\u0161ta Slovenije) for deliveries in Slovenia, and through other postal providers (DPD, GLS) in case of deliveries to other countries.

METHOD OF PAYMENT:\nThe customer can choose between two payment methods:

payment with payment cards\nwith a PayPal account\nPAYMENT WITH PAYMENT CARD

The ordered products can also be paid with the following payment cards: Mastercard, Visa.

Payment card payment process:
when the item is added to the shopping cart, you can either continue shopping or if you want to buy only one item, click on cart icon at the top right;\nyou will see the summary of your shopping cart with total amounts and potential discounts;\nby clicking on the \u201ccheckout\u201d button you will be presented with two options \u2013 you can shop either as a guest or as a registered user;\nafter the appropriate selection, an instant purchase will be displayed;\nafter filling the customer\u2019s data, select the option \u201ccredit card (Mastercard, Visa)\u201d;\ncheck the data;\nclick on the \u201csubmit order\u201d button to submit your order, and then you will be redirected to a secure payment website;\nin the \u201ccard number\u201d field, enter the debit card number or PAN and CVV, if the card has it;\nselect card expiration in \u201cexpiration date\u201d field;\nclick on the \u201csubmit\u201d icon to confirm the purchase;\nThe purchase is completed with a click on \u201cPay\u201d icon.\n

PAYMENT WITH A PAYPAL ACCOUNT

PayPal provides secure payment with credit cards, such as MasterCard \/ Eurocard, Visa, American Express, etc. It is an anonymous, reliable and fast payment method that does not require filling of credit card data every time you make a purchase. The purchase payment method is as same as other payment methods, but in this case, select \u201cPayPal Standard\u201d. This will automatically redirect you to your PayPal account page where you can make the payment to complete the purchase.

DELIVERY:\nDelivery of all orders from our online shop http:\/\/kocbek.si, is performed by our contractual partner Po\u0161ta Slovenije, or by DPD or other courier services. Within three working days, the ordered products will be submitted to our contractual partner for delivery. If it is not possible for any specific reason, we will inform the customer about it and agree with him the delivery in a different manner. The products will be delivered to the address provided by the customer. If currently, the ordered products are not available, we will notify you by e-mail or telephone.

Delivery costs:

Delivery costs for all products are according to the price list of the contractual partner and depend on the quantity of the ordered products. Delivery costs are calculated when a product is purchased on our website and are given to the customer before the payment is completed. All orders above the value of 60 euros (VAT included) are delivered free of charge to customers of our online shop http:\/\/kocbek.si (applies to orders delivered within Slovenia). For orders outside Slovenia, delivery costs are charged in accordance with the DPD courier service price list. The price list is on this page in an pdf file.

Delivery costs in case of improper deliveries and returns:

In case of an improper delivery or justified quality claim (broken product, etc.), we bear the costs of normal transport of returned products and replace it with the appropriate ones

Delivery time:

Delivery of the ordered products purchased through the online shop http:\/\/kocbek.si will be effected no later than 3 working days after hand-over of the products to our contractual partner Po\u0161ta Slovenije, DPD or another courier service.

RIGHT TO CANCEL THE PURCHASE, RETURN PRODUCTS, REFUND:\nThe customer has right, within 14 days of the receipt of the ordered products, to send an e-mail to the e-mail address: info@kocbek, informing the seller of his cancellation of the contract or order, without having to state the reason for his decision.

In case the customer has already received the products and wants to cancel the contract, he has to return the products undamaged and in the original quantity to the seller\/ company within 14 days after the message informing the seller of his cancellation of the contract or order has been sent. The only cost charged to the customer in respect of cancellation is the cost of returning the products.

The customer shall return the received products undamaged and in their original condition, except in the case when the products have been damaged without the customer being responsible for it. We will refund the payments made by the buyer as soon as possible, and at the latest within 14 days after the receipt of the notice of cancellation of the contract and the receipt of damaged or rejected products.

Pursuant to paragraph 5 of Article 43.\u010d of Law on Consumer Protection (ZVPot), the customer does not have the right to cancel the contract (purchase) if it concerns a custom-made product, according to the exact instructions of the customer, which has been adapted to his personal needs (e.g. Gift package composed of items requested by the customer). The refund is credited in the same currency as the original payment by the customer.

GENERAL SALES CONDITIONS:\nSales agreements and conditions can be diverse, but only agreements confirmed in writing shall be valid.

CONCLUSION OF THE CONTRACT:\nA written order is binding on the customer. The contract can be concluded in the Slovenian language, and for foreign markets in the English language.

ARCHIVING CONTRACTS:\nAll concluded contracts (online shop orders) are archived with Oljarna Kocbek, Gorazd Kocbek s.p. Stara gora 1, 9244 Sv.Jurij ob \u0160\u010davnici. In case the customer requires a copy of the concluded contract, he can obtain it at the above-mentioned location. We can also send you the required contract by e-mail. Please send your request to our e-mail address.

COMPLAINTS AND DISPUTES:\nThe seller shall respect the current customer protection legislation and make every effort to fulfil his duty to establish an effective complaint handling system. The complaint is to be submitted via e-mail info@kocbek.si or in writing to the address Kocbek Oljarna, Gorazd Kocbek s.p. Stara gora 1, 9244 Sv.Jurij ob \u0160\u010davnici. The complaint processing procedure is confidential. In case the seller fails to settle the customer\u2019s complaint, he shall inform the customer about the reasons for rejecting the complaint and give him the options for further resolution of the dispute.

OUT-OF-COURT SETTLEMENT OF DISPUTES:\nDirective 2013\/11\/EU of the European Parliament and the Council of 21 May 2013 on the alternative dispute resolution of consumer disputes and the amendment of Regulation (EC) No 2006\/2004 and Directive 2009\/22\/EC (OG L No. 165 of 18.6.2013, p. 63) have been introduced into the Slovenian legislation by Law on out-of-court settlement of consumer disputes. Pursuant to paragraph 3 of Article 32 of Law on out-of-court settlement of consumer disputes, Official Gazette of the Republic of Slovenia, no. 81\/15, the seller does not accept any provider of the out-of-court settlement of consumer disputes as an authorized person for resolving of consumer disputes, which the consumer may initiate in accordance with this Law.

Kocbek.si, as a seller, dealing with online sales and online services, has on his website an electronic link to the Online Dispute Resolution platform, that is available to consumers here.

DEFECTIVE PRODUCTS:\nA product shall be considered really defective: if the product does not have the characteristics necessary for its normal use or\nmarketing if the product does not have the characteristics necessary for the particular use, for\nwhich the customer bought it, but which the seller had known of or should have known before;\nif the product does not have the characteristics and features that were explicitly or\nimplicitly agreed or described;\nif the seller has delivered a product that does not match the sample or model,\nunless the sample or model has been shown only for advertising purpose.

The suitability of the product for normal use is checked against the usual products of the same type and their compliance with any seller\u2019s declarations of the characteristics of the products given by the seller or the manufacturer, in particular in advertising, presentation of the product or indications on the product itself.\nThe customer has to inform the seller of any defect together with the exact description and photographs of the product, at his own expense, and within the statutory deadline, as well as to allow the seller to inspect the product.

The customer, who has properly informed the seller of the defect has the right to require from the seller:\n\nthe removal of defect on the product;\nthe refund of a part of the amount paid in proportion to the defect;\nthe refund of the paid amount;\nor the replacement of a new product.\nMore specifically, the right to claim damages is regulated by Law on Consumer Protection

COMMUNICATION:\nCommunication with the customer\/user will be performed via means of distance communication, unless explicitly otherwise stated by the user.
